1. Acceptance

By inviting, accessing, or using Mallard, the server owner and any users interacting with the bot agree to these Terms of Service with Anatinae Ltd ("the operator"). If you do not agree, do not invite or use the bot or dashboard.

2. Service Description

Mallard is a modular Discord bot and dashboard used to manage Discord server features, including moderation tools, modules, scripts, and configuration data.

3. No Warranties

• There are no uptime, performance, or availability guarantees.
• Functionality may change, be paused, or be removed at any time without notice.
• Errors, delays, bugs, rate limits, outages, and data loss may occur.
• No guarantee is made that any feature will be compatible with Discord changes.

4. Limitation of Liability

To the maximum extent permitted by law, the operator of Mallard is not liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the use or inability to use the bot, dashboard, or related services. This includes, without limitation, loss of data, loss of access, moderation mistakes, service interruptions, API issues, Discord actions, or server disruptions.

5. User Responsibility

• Server owners are responsible for reviewing and configuring all permissions and modules.
• Moderation actions are the responsibility of the server staff who invoke them.
• You are responsible for backing up your own data and settings where applicable.
• You must comply with Discord's Terms of Service, Community Guidelines, and applicable laws.

6. Permitted Use

You may not use Mallard for illegal activity, harassment, spam, abuse, credential theft, malware, or any activity that violates Discord policies or applicable law. The operator may restrict or revoke access at any time for suspected abuse, policy violations, or operational risk.

7. Data and Content

Mallard may process Discord identifiers, guild configuration, moderation records, and related data necessary to provide the service. The operator may retain, delete, or modify stored data as needed for security, maintenance, legal compliance, or service operation. No guarantee is made that any data will be preserved permanently.

8. Third-Party Services

Mallard depends on third-party services, including Discord, hosting providers, and database providers. The operator is not responsible for outages, rule changes, API changes, or failures caused by those third parties.

9. Changes and Termination

These Terms may be updated at any time. Continued use after changes means you accept the updated terms. Access may be suspended or terminated at any time without notice.
